Definitions: Marketing Technology, Inc. (“Site Owner”), web site (the "Site").

Governing Law—Binding Arbitration
The laws of the State of Maryland shall govern the relationship between Site Owner and its Users. As a condition of use and all benefits accruing thereto, including, but not limited to, access to the Site, Users consent to the exclusive jurisdiction and venue of the American Arbitration Association, in Montgomery County, Maryland. Any and all disputes arising out of the access to (or denial thereof) or any act or omission taken or omitted to be taken in reliance on any content, links or referral sources contained on the site shall be exclusively resolved by One (1) arbitrator selected in accordance with the rules of the American Arbitration Association applying the laws of the State of Maryland except those laws relating to the choice of laws. Site Owner shall be entitled to recover its attorney fees and arbitration and court costs in connection with the investigation, defense or prosecution of all actions in which it is, or potentially could become a party. Under no circumstances shall any User be entitled to any monetary damages or reimbursement for attorney fees or costs in excess of one Dollar. Such arbitration shall be binding upon the parties. Such arbitration and all information relating thereto shall remain strictly confidential. Any monetary award rendered by the arbitrator shall be enforceable in the Federal or State courts of the State of Maryland. Users consent to the exclusive jurisdiction and venue of the Federal or State courts of the State of Maryland for such enforcement purposes.
